END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (either an individual or a single entity) and Waypoint Studios Ltd for the use of Packager by Waypoint (“Software”).

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.

LICENSE GRANT
Waypoint Studios Ltd grants you a non-exclusive, non-transferable license to install and use the Software solely for commercial purposes related to Minecraft product packaging and previewing, in accordance with this Agreement.
OWNERSHIP
The Software is licensed, not sold. Waypoint Studios Ltd retains all right, title, and interest in and to the Software, including all intellectual property rights.
RESTRICTIONS
You may not:

Reverse engineer, de-compile, or disassemble the Software;
Modify, adapt, or create derivative works based on the Software;
Resell, sub-license, rent, lease, or distribute the Software to third parties;
Use the software in a way that causes or encourages others to violate the Minecraft End User License Agreement or Mojang’s terms of service..

TERMINATION
This license is effective until terminated. It will terminate automatically without notice from Waypoint if you fail to comply with any provision of this Agreement. Upon termination, you must cease all use and destroy all copies of the Software.
DISCLAIMER OF WARRANTY
The Software is provided “AS IS” without warranty of any kind. Waypoint Studios Ltd disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Waypoint Studios Ltd shall not be liable to you or any third party for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Software, including but not limited to loss of profits, loss of data, or business interruption, even if Waypoint Studios Ltd has been advised of the possibility of such damages. The Software is provided “as is” and “as available” without any warranties of any kind, either express or implied. You acknowledge that the Software is provided free of charge and that Waypoint Studios Ltd’s total liability under or in connection with this EULA, whether in contract, tort (including negligence), or otherwise, shall not exceed £100. The parties agree that the limitations and exclusions of liability in this Agreement are reasonable given the nature of the Software and the fact that it is provided free of charge. Nothing in this EULA shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
